Mr. Rible will discuss various types of Control of Damaged Goods Clauses: the Good, the Bad and the Ugly. Complications involve the insured’s interpretation of government regulations, conflicting clauses in recent forms of policies, and destructive testing. The session will also include review of several court decisions and the implied in law requirements of a “fortuitous event” and “reasonableness.” Finally, Mr. Rible will address new government regulations concerning pharmaceuticals, the supply chain, and food. New regulations are being implemented despite the concerns of the Executive Branch.
